WE CAN REMAIN UNITED.

Last Monday's Court ruling on inclusion of Kadhi's Court into Bomas and other Constitution draft as illegal and unconstitutional has coursed so much noise from politicians, civil societies and lawyers who all agree that the decision by the three honorable judges will give undue mileage to those who are opposed to the proposed draft Constitution.

The outrage expressed by this groups of people is shocking given that they have always insisted that Kadhi court are a right already being enjoyed by a section of marginalized nationals of this country and therefore any subsequence Constitution should not remove that right. With this decision then the above reason would not hold ground anymore. For this reason my opinion is that we need to pause and correct the anomalies that are in the proposed Constitution before subjecting it to the referendum.

The people of Kenya have lived as one Nation and one People all along. This I belief was because none of us ever felt discriminated against by the Constitution that we are about to repel although it had many flaws in it. The Proposed Constitution although loaded with many benefit will not be acceptable to quite a big chunk of Kenyan if it passed in the referendum the way it is. If this then be the case all benefit will be watered down by disunity among the people of this great Nation.

The two sides need to halt their campaigns for a moment and reflect on the effects of the outcome of their vote. At the moment the race is so cross to call. This then means that any side has capability to carry the day after referendum. The Green are over confidence that they will win and that is why the can not listen to the Red side. This will be a fatal mistake should the opposite happens. We will have wasted a golden chance to have a Constitution for this Nation.

I have listened to the Church leaders and I can attest that they are not against the Constitution but are against a flawed Constitution. If then all of us want a Constitution that will guarantee our right and justice then let not waste this moment with our grandstands. We can talk and listen to one another with the spirit of give and take. That is the only way forward and with it a referendum will only be a rubberstamp.
